Wage Disputes and Rest Period Violations

What is the minimum wage?

As of July 2022, the minimum wage rates per hour are as follows:


  • California (with 26 or more employees): $15.00
  • California (with 25 or fewer employees): $14.00
  • Unincorporated Areas in Los Angeles County: $15.96
  • City of Los Angeles (except LAX, specified hotel, and healthcare workers as defined by City Ordinance): $16.04
  • City of Long Beach (with 26 or more employees) (except hotel, concessionaire, and healthcare workers as defined by City Ordinance): 
  • City of Long Beach (with 26 or more employees) (except hotel, concessionaire, and healthcare workers as defined by City Ordinance): $15.00

If you are a salaried worker, your hourly pay equivalent should meet minimum wage requirements.


In addition, you should also receive reimbursements for traveling and mileage if travel and driving is required for your job.


Please reference the California Department of Industrial Relations website for the Schedule of Minimum Wage rate until 2023.

What overtime pay am I owed?

In the state of California, workers are owed overtime wages when they work more than 8 hours a day or more than 40 hours a week.

How many breaks am I supposed to get?

Workers in California are entitled to:


  • A 10-minute "duty-free" and uninterrupted rest period for every 4 hours worked
  • A 30-minute “duty-free” and uninterrupted meal period for every 5 hours worked
  • A second 30-minute "duty-free" and uninterrupted meal period when they work more than 10 hours a day

What if I am an independent contractor?

You may be misclassified as an independent contractor, depending on your role, duties, or responsibilities.
