Wrongful Termination

How do I know if I have been wrongfully terminated?

Getting fired can often feel unfair. However, there is a difference between an unfortunate circumstance and unlawful wrongful termination.


So how do you know if your termination was unlawful?

Termination of employment is not legal if it is based on discrimination of any of the following:

  • Race, color
  • Nationality, national origin, ancestry
  • Religion, creed
  • Age (over 40)
  • Disability - mental or physical
  • Sex, gender
  • Sexual orientation
  • Gender identity, gender expression
  • Medical condition (including pregnancy, childbirth, breastfeeding, or related medical conditions)
  • Genetic information
  • Marital status
  • Military and/or veteran status

Termination of employment is not legal if it is in retaliation for whistleblowing of the following:

  • Complaining about unpaid wages
  • Complaining about unsafe work conditions
  • Complaining about other violations of law
  • Refusing to engage in unlawful conduct
  • Reporting (internally or externally) unlawful conduct

What do I do if I have been wrongfully terminated?
